Withdrawing from the contract by means of an express written declaration

Every customer has the right to exercise his right of rescission by withdrawing from the contract within 14 days of receiving the goods through submission of a written rescission notice and without stating any reasons. Mailing the written rescission notice within this period shall suffice (the date of the postal stamp shall serve as proof). In such case, the customer is obliged to immediately return the goods. The customer shall bear the shipping costs or postage fees for the goods returned. If the goods have been used and/or damaged, the customer shall pay the seller a reasonable compensation which amount shall however be limited to the invoice value of the goods in question. Withdrawing from the contract by means of simply returning the goods 

The customer has the right to exercise his right of rescission by simply returning the goods within 14 days of receiving the same and without submission of a written rescission notice. A proof of the timely return shipment of the goods shall suffice to comply with the 14-day withdrawal period. In order for the customer to exercise this form of withdrawal from the contract, the customer is obliged to ensure that the goods are returned unused and undamaged and that sufficient postage has been paid for the return shipment. The seller shall only bear the shipping costs or postage fees for the goods returned if a wrong or defective delivery has been made.

The customer shall bear both the risks and proof of the return shipment. In case of a rescission by the customer (by means of an explicit written declaration or the simple return of the goods), the seller shall immediately reimburse the customer with the purchase price paid – shipping costs shall not be reimbursed. When ordering goods on an open account basis, the customer’s account will be credited with the amount due for the goods purchased. 

Return of Goods

The modalities set out in this section (“Return of Goods“) do not serve as prerequisites for the effective execution of the right of rescission.

Prior to any return of goods, customers are kindly requested to contact and inform the sales person (via email to sektkellerei@szigeti.at) of a return of goods. This enables the sales person to allocate the products as quickly as possible.

Customers are requested to return the goods to the seller in a duly stamped package and keep the postage receipt. The seller will refund the postage fees paid by the customer in advance, provided that these postage fees do not have to be borne by the customer.

Customers are requested to handle goods with due care to protect them from damage and dirt. The goods and any accessories should be returned to the seller in the original packaging. If the original packaging is no longer available to the customer,[U1]  an equally suitable type of packaging should be used to adequately protect the goods from damage during transport and prevent any claims for damages on part of the seller because of inadequate packaging.
